These are the Terms of Service shown in QuickCalm. By using the app, you agree to these terms. If you do not agree, do not use the app.

1. General Wellness Notice
QuickCalm is designed for general wellness, education, and self-guided mindfulness support. The App: - Offers mindfulness, grounding, reflection, and habit-building tools - Is not a replacement for professional care or personal advice from a qualified provider - Should not be used for emergencies or urgent safety needs If you feel unsafe or need urgent help, contact local emergency services, a trusted professional, or a local crisis resource.
2. Intended Use
QuickCalm helps users practice calming skills, reflection habits, and self-reported check-ins for everyday stress support. For background on the concepts used in the app, see the Background & Safety page in the app.
3. Eligibility and Age Requirements
You must be at least 13 years old to use QuickCalm. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have parental or guardian consent to use the App. By using QuickCalm, you represent that you meet these age requirements.
4. Account Registration and Security
- You must provide accurate and complete information when creating an account - You are responsible for maintaining the confidentiality of your account credentials - You are responsible for all activities that occur under your account - You must notify us immediately of any unauthorized access or security breaches - You may not share your account with others - We reserve the right to terminate accounts that violate these Terms
5. Acceptable Use
You agree to use QuickCalm only for lawful purposes and in accordance with these Terms. You agree NOT to: - Use the App in any way that violates applicable laws or regulations - Impersonate any person or entity or misrepresent your affiliation - Interfere with or disrupt the App's servers or networks - Attempt to gain unauthorized access to any part of the App - Use automated systems (bots, scrapers) to access the App - Reverse engineer, decompile, or disassemble any part of the App - Remove or modify any proprietary notices or labels - Use the App to harm, harass, or threaten others - Upload malicious code, viruses, or harmful content
6. Subscription Terms and Payments
QuickCalm offers subscription-based access to premium features: Available Plans: - Weekly subscription: Billed weekly at the current rate - Annual subscription: Billed annually at the current rate Billing and Auto-Renewal: - Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase - Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period - Your account will be charged for renewal within 24 hours prior to the end of the current period - You can manage subscriptions and turn off auto-renewal in your device's Account Settings Free Trials: - Free trials or introductory offers, if available, are shown before purchase - You must cancel at least 24 hours before any trial or introductory period ends to avoid being charged - Any unused portion of a free trial will be forfeited when you purchase a subscription Pricing: - Localized prices are shown in the app and may vary by region - Prices are subject to change with notice - Price changes will not affect current subscribers until their next renewal
7. Cancellation and Refunds
- You may cancel your subscription at any time through your App Store or Google Play account settings - Cancellation takes effect at the end of your current billing period - No refunds are provided for partial subscription periods - Refund requests are handled by Apple or Google according to their respective refund policies - We reserve the right to issue refunds at our sole discretion
8. Account and Data Deletion
- You may delete all your app data at any time from the Settings screen - You may permanently delete your account and all associated data from the Settings screen - Account deletion is permanent and cannot be undone - Deleted data cannot be recovered - Account deletion does not automatically cancel your subscription; you must cancel separately - After deletion, we retain data only as required by law or for legitimate business purposes (typically 30-90 days for backups)
9. Intellectual Property Rights
The App and its entire contents, features, and functionality (including but not limited to all information, software, text, audio, images, and design) are owned by QuickCalm and are protected by United States and international copyright, trademark, and other intellectual property laws. - You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes - You may not copy, modify, distribute, sell, or lease any part of the App - All audio content, course materials, and program frameworks remain our property - User-generated content (your personal entries) remains your property
10. User Content and Data
- You retain ownership of all data and content you create in the App - You grant us a limited license to store and process your data to provide the Service - You are responsible for the accuracy and legality of your content - We may remove content that violates these Terms - We do not claim ownership of your personal wellness entries
11. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using QuickCalm, you consent to our Privacy Policy.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: - THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND - WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT - WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES - WE ARE NOT LIABLE FOR PERSONAL DECISIONS, URGENT SITUATIONS, OR PERSONAL INJURIES ARISING FROM USE OF THE APP - OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS - WE ARE NOT RESPONSIBLE FOR INTERNET CONNECTIVITY ISSUES, DEVICE MALFUNCTIONS, OR THIRD-PARTY SERVICE FAILURES
13. Indemnification
You agree to indemnify, defend, and hold harmless QuickCalm, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: - Your use or misuse of the App - Your violation of these Terms - Your violation of any rights of another person or entity - Any content you submit or transmit through the App
14. Modifications to the Service
We reserve the right to: - Modify or discontinue any part of the App at any time - Change subscription pricing with advance notice - Add or remove features - Perform maintenance that may temporarily interrupt service We will make reasonable efforts to notify you of significant changes.
15. Termination
- You may terminate your account at any time by deleting it from Settings - We may terminate or suspend your access immediately, without notice, for any violation of these Terms - Upon termination, your right to use the App ceases immediately - Provisions that should survive termination will remain in effect (e.g., liability limitations, dispute resolution)
16. Dispute Resolution and Arbitration
Informal Resolution: Before filing a claim, you agree to contact us at support@deanxious.com to attempt to resolve the dispute informally. Arbitration Agreement: Any dispute arising from these Terms or the App will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify. The Federal Arbitration Act governs this agreement. Class Action Waiver: You agree that disputes will be resolved on an individual basis only, and you waive the right to participate in class actions or class arbitrations.
17. Governing Law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. You consent to the exclusive jurisdiction of courts located in California for any disputes not subject to arbitration.
18. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via: - Email notification - In-app notification - Posting the updated Terms within the App Your continued use of QuickCalm after changes take effect constitutes acceptance of the new Terms. The "Last Updated" date at the top of this page indicates when these Terms were last revised.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuickCalm regarding the use of the App and supersede all prior agreements.
